How to Get an Abandoned or Illegally Parked Vehicle Towed
Here's a guide on how to report a vehicle and the 72-hour period you need to consider before it can be towed.
Dealing with an abandoned or illegally parked vehicle can be frustrating, especially if it’s blocking your driveway, parked in a no-parking zone, or causing an inconvenience in another way. Knowing how to properly report the vehicle and the steps involved in getting it towed is important.
The 72-Hour Rule for Towing an Illegally Parked Vehicle
In accordance with Oregon Revised Statute 98.830, a vehicle
cannot be towed immediately.
There must first be a
Towing Warning Notice affixed to the vehicle for
at least 72 hours before the vehicle can be towed. This gives the vehicle owner time to move the vehicle or correct the violation.
What is a Towing Warning Notice?
A Towing Warning Notice is a clearly visible notice affixed to a vehicle that is in violation of parking regulations. This notice must remain on the vehicle for at least 72 hours before the vehicle can be towed. The notice should include:
- Reason for Towing: Clearly state the violation, such as illegal parking or abandonment.
- Deadline for Removal: Set a clear deadline for the vehicle owner to retrieve their vehicle.
- Date When Notice Was Issued: Include the date and time the notice was affixed to the vehicle.
- Towing Information: Provide contact details for the towing company, including the name, and phone number.
It's important that the notice is affixed in a manner that ensures it will remain visible and legible, such as placing it under the windshield wiper or on the driver's side window. Once you've affixed the notice, take a photo as proof. This practice helps ensure compliance with Oregon's towing laws and provides the vehicle owner with the necessary information to address the violation.
